Florida: The Mortgage Foreclosure Bottleneck

Saturday, March 14th, 2009

Florida has a new hurricane coming her way, and it looks like a big one.  Foreclosures are on the rise, the dockets are overflowing, and the state’s judicial system is looking for sandbags.

According to Central Florida News, Orange County’s Chief Circuit Judge Belvin Perry, Jr., has signed an order that gives homeowners the right to insist that their foreclosure case be mediated.  The order only applies to owner-occupied homes, but if they are financially ready, these homeowners now have more negotiating power.

The order has not mandated mediation, however, and the Orlando Sentinel says that’s just fine with Circuit Judge R. James Stroker.  The Sentinel reported that Judge Stroker is opposed to mediation on the grounds that it will create an even more overwhelming load on his court than he already has.  He believes that the number of homeowners who would benefit from mediation are not numerous enough to warrant a change in procedure.

This past week, the Miami Herald reported that mortgage delinquencies are up to 20% in Florida, and that Miami’s foreclosures now constitute 75% of their Circuit Courts’ workload.  The newspaper also said that the Center for Responsible Lending has estimated that court-supervised modifications could save over 100,000 Florida mortgages.  A new task force created by the Florida Supreme Court is charged with investigating the best way to remove the judicial bottleneck, and one of the options on the table is statewide mandatory foreclosure mediation.

If your home is on the line, you should know that mediation can actually provide a quick, efficient resolution that will satisfy both you and your lender.  With several offices throughout Florida, CFR may be able to help.  Contact us to arrange a personal, private consultation about how to stay in your home.
